Session 1770 <br />November 22, 1999 <br /> <br />Mr. Lieberman, Mr. Sharpe, Mr. Schoomer, Mr. Wagner, Mr. Munkel, Ms. Colquitt all agree <br />to keep the current ballot order position method - who gets there the earliest and lines up <br />by the elevator gets the best ballot order position. <br /> <br />Mr. Munkel stated that checking that each council appointee were not in arrears in city fees <br />and taxes had always been done. He does not really know who was doing this and is not <br />sure who should be doing it. <br /> <br />Mr. Lieberman said that in the past that taxes was always checked, but what was not clear <br />was that the user fees were not clear. This law now clarifies this question. Now all of <br />these types of fees are now included. The question who should be responsible for checking <br />this information. He believes it should be the City Clerk. <br /> <br />Mayor Adams said that is the question. Does the Council direct the City Clerk to check the <br />payment status of taxes and municipal user fees prior to placement on the ballot. <br /> <br />Mr. Sharpe believes that this task should be the City Clerk's responsibility. <br /> <br />Mr. Schoomer agrees with Mr. Sharpe. <br /> <br />Mr. Munkel believes it would be an appropriate role to the City Clerk's duties since this <br />position handles the election process anyway. This should include only municipal taxes <br />and user fees. <br /> <br />Mr. Schoomer said that we should check to see if we can charge the state back fees for this <br />mandated service. Mayor Adams said that was definitely a question that should be looked <br />into, since it does fall under the Hancock amendment. <br /> <br />Mayor Adams stated that the City Clerk would now be charged for checking to see that all <br />candidates were current with municipal taxes and user fees, in order to be certified as a <br />candidate. <br /> <br />Responding to Mr. Lieberman, Mayor Adams stated that if someone came in at 5:00 p.m., <br />the last day of filing and the City Clerk found out that this person was in arrears on user <br />fees the next day and pays it up current- he would still be off the ballot. The fees/taxes <br />must be receipted by 5:00 p.m. the last day of closing to be certified as a candidate. <br /> <br />CITIZEN COMMENTS: <br /> <br />Suzanne Louie, 708 Radcliffe, is representing the early morning swimmers out at Heman <br />Pool.
