Session 1773 <br />January 24, 2000 <br /> <br />Courtney Vollmer, 6918 Washington, stated that they have attempted to dot every "i" and <br />cross every "t" with this project. She has spoken to the minister of the church who told her <br />that he had every intention of signing the petition, but unfortunately, they have a myriad of <br />committees that they have to go through in order to get permission and that it probably <br />could not be done within their time frame. She stated that there was no agenda in trying to <br />get this pushed through. They are just trying to save some engineering fees. Mr. Ollendorff <br />has offered to include their project needs into the City's spring bidding process. He told <br />them that it would save them approximately $8,000. She feels, however, that they do not <br />have to sit on this to appease a very small portion of the people. <br /> <br />The mayor called the question. <br /> <br />Mr. Munkel moved approval. Mr. Sharpe seconded the motion. <br /> <br />Mr. Lieberman asked if the passage of this resolution established the public hearing date or <br />if it should. Mr. Ollendorff responded that the public hearing date can not be established <br />until the plans and specifications had been drawn up. <br /> <br />Mr. Schoomer said that he believes that there is approximately 8 weeks before the Council <br />can act on this. Mr. Oliendorff responded that they are aiming at getting this project <br />included in the City's spring bids for curbs and sidewalks and street resurfacing. This <br />needs to be done by the first part of April. Responding further to Mr. Schoomer, Mr. <br />OIlendorff said that the Council does have the authority to order the improvement of a <br />private street, even over the trustee's objections. <br /> <br />Mr. Munkel stated that the trustee would have plenty of time to discuss this with his <br />attorney and also the church would have time to review this before the public hearing. <br />They should go ahead and move in this direction, but he feels we should proceed with the <br />planning process tonight. <br /> <br />Mr. Koczan stated that when he spoke with the City Attorney, Mr. Mulligan, there was <br />some confusion, because he had understood that this was a public street in a private <br />subdivision. Mr. Koczan stated that he corrected him saying that it was a private street in <br />a private subdivision. Mr. Mulligan responded to him stating that he did not think that this <br />had any bearing on this process, but he would look into it. Furthermore, he stated that he <br />was not against this process. He believes it is a fine idea, but he believes it should be done <br />in a proper sequence and a proper order. Mayor Adams stated that the final action would <br />not be taken for some time, as indicated by Mr. Ollendorff, so there is still time for the <br />attorney and the church to do what they need to do.
