Session 1773 <br />January 24, 2000 <br /> <br />Attorney did take a look at the public street versus private street question and decided it <br />had no bearing. <br /> <br />The motion carried unanimously. <br /> <br />BILLS FOR SECOND AND THIRD READINGS: <br /> <br />Mayor Adams stated that there were a couple of citizens wishing to discuss the <br />next bill, No. 8447, regarding the public walkway right-of-way vacation. <br /> <br />Ruth Hardin, 525 N. Central, said that she was here to discuss the vacation of the <br />public path that is on the south side of her property. Half of it has already been <br />vacated because of the new development on North and South. She has no <br />objections to this vacation or to the proposal to remove the concrete. She does <br />request that after it is removed, that the area be leveled and resodded. <br /> <br />Mr. Ollendorff said that the contractor would do the work at Council's behest. <br />Council directed Mr. Ollendorff to order the contractor to do the work. The work <br />will be done at the contractor's expense, not the adjacent neiShbors or the City. <br /> <br />Mr. OIlendorff says that the City Clerk will record the ordinance and once <br />returned, she will also send a copy of that to each of the adjacent owners. <br /> <br />Kathleen Gund, 521 N. Central, said that she is the owner of the property that is <br />directly south of the walkway. She is in opposition to the City vacating the <br />walkway in its current condition. Her homeowners insurance rep told her that <br />pavement on anyone's property is an invitation for someone to walk on it. He told <br />her that it would increase her liability. Her recommendation is that the City not <br />vacate the property until the concrete is removed. She would also reiterate what <br />Mrs. Hardin said, and encourage resodding versus reseeding. They feel that the <br />lay of the land there would just encourage a big mud pit. <br /> <br />BILL NO. 8447 - VACATING AND SURRENDERING A PUBLIC WALKWAY RIGHT- <br />OF-WAY FROM NORTH & SOUTH BLVD, TO CENTRAL AVE. IN BLOCK 4 OF <br />DELMAR HEIGHTS SUBDIVISION AND DIRECTING THAT THIS ORDINANCE BE <br />RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />5 <br /> <br /> <br />
