Janet Baum 6819 Pershing, agent of Ames Place Subdivision, addressed the Plan Commission. <br />Ms. Baum stated that she appreciated the questions asked by Plan Commission members and <br />asked if there had been sufficient time to absorb the information in the traffic study for them to <br />base a decision on. <br /> <br />Jan Scott 6960 Kingsbury, addressed the Plan Commission. Ms. Scott stated she had concerns <br />about ingress and egress out of their subdivision and the Trolley created a lower level of service <br />and it would only get worse. She added that the court only granted the Transportation <br />Development District the boundary to stop east of Kingsland, not west. She also had concerns <br />about traffic congestion on Delmar. <br /> <br />Ms. Riganti stated that the boundaries of the Transportation Development District, according to <br />state statutes, the funds could be used outside of the boundaries. <br /> <br />Staff Comments <br /> <br />Mr. Greatens stated that the proposed roundabout was not considered a part of the C.U.P. <br />application and the request only pertained to the proposed Loop Trolley. He stated that the <br />request was to allow a public utility facility in the Delmar Boulevard right-of-way in the CC and <br />PA Districts. He added that the primary impact in the proposed use was related to traffic, which <br />was why more emphasis was on traffic related issues in the staff report. Mr. Greatens stated that <br />staff and the Traffic Commission would require nine parking spaces be replaced at locations yet <br />to be determined and that the Department of Public Works and Parks (PWP) had indicated that <br />the level of service proposed was acceptable and that all recommendations from PWP must be <br />implemented in the final design plans for the Trolley. He stated that is was the opinion of staff <br />that the proposed Trolley was compatible with surrounding uses and appropriate at this location <br />and, with appropriate conditions, would not have a detrimental impact on the surrounding area; <br />staff recommended approval with the conditions in Attachment B of the staff report. Mr. <br />Greatens read the requirements specified by PWP and stated the operation should comply with <br />the performance standards in the Zoning Code. <br /> <br />Ms. Riganti stated that the issue was a C.U. P. to determine if the proposed installation and <br />operation of the Trolley should be allowed, not whether or not the Trolley should be installed. <br />She added that the City Council had endorsed the Trolley concept. She stated that per the <br />Zoning Code, the issue was if the conditions adequately address any issues per the standards to <br />approve a C.U.P., not whether or not the Trolley should be approved. <br /> <br />Mayor Welsch stated that City Council had issued a letter of support for the Trolley. <br /> <br />Ms. Riganti added that recently the City took over ownership for this portion of Delmar, which <br />allowed for more control over what could occur in the right-of-way. Ms. Riganti explained the <br />Conditional Use Permit process further and explained that a public utility facility was a <br />Conditional Use in the zoning district where the proposed trolley would be located. <br /> <br />tğŭĻ Ѝ ƚŅ А <br /> <br />
