Since so many items must be considered, he suggested <br /> tabling this matter to the next meeting in order to give all concerned the op- <br /> portunity to get together and decide what the conditions should be. <br /> Mr. Schooner said it is not up to Council to determine ownership, and he be- <br /> lieved the City Manager's objections could be met by setting conditions. Mr. <br /> 011endorff said he would not object if all conditions could be set now, but he <br /> felt that might be difficult. Mayor Majerus said it was not Council's place <br /> to make decisions about drainage and other areas in which they have no exper- <br /> tise, and she felt it would be prudent to follow the City Manager's ren- <br /> dation and table this to the next meeting. Mr. Wagner agreed and moved to ta- <br /> ble. Prior to a second, Mr. Schooner asked that the applicant cane forward. <br /> Mr. Charles Deutsch, #1 McKnight Place, said he was president of the Torah <br /> Prep Building Committee, and that the School would like to get the road built <br /> before school starts in September. As a developer, he saw no particular prob- <br /> lems with building the road, and said professional plans will be drawn and <br /> submitted to Public Works for approval, as well as landscape and lighting <br /> plans. He said his group has met with TOMCO several times. Mr. Wagner asked <br /> why they wanted to build a new road when the School already has an existing <br /> access from Olive. Mr. Deutsch described the easement location, and said the <br /> School wanted its own ingress/egress to avoid traffic problems which they <br /> sometimes had on Sundays when the church parking lot is used. <br /> Mrs. Schuman said TOMCO seemed to have serious concerns about the proposed <br /> roadway that she felt should be addressed before a decision was made. She <br /> noted that some of the conditions put on the site plan last simmer have not <br /> yet been met, such as a playground fence. Mr. Deutsch said he did not object <br /> to meeting again with ItMCO representatives to try to resolve the problems. <br /> Mr. Robert Killion, representing TOMCO, 1435 Woodson Road, said he met with <br /> Mr. Deutsch quite briefly only once. He noted there was disagreement about <br /> who owned the easement, and said TOMCO has maintained this strip for at least <br /> seven years, with Durbin-Durno maintaining it prior to that. Mr. 011endorff <br /> said the Council will not determine who owns the property or has a right to <br /> use it; however, there is an application before Council for a legitimate use <br /> of the property, but it is subject to site plan approval which allows Council <br /> to set conditions. He suggested tabling until after Torah and TOMCO meet to <br /> decide if there will be a road, and then conditions can be decided on and at- <br /> tached to the approval. Mr. Killion said that would be satisfactory to TOMCO. <br /> In response to Mr. Adams, the First Ward councilmembers said they had received <br /> no feedback on this proposal from nearby residents. Mrs. Schuman seconded Mr. <br /> Wagner's motion, and all voted Aye except Mr. Schooner, who voted Nay. Mr. <br /> Deutsch said he would call Mr. Killion the next day to arrange a meeting. <br /> YEAR-END BUDGET TRANSFERS <br /> The City Manager recommended approval of year-end budget transfers to accounts <br /> (me where added expenditures are needed from accounts where funds are available. <br /> Mr. Price moved approval, and Mr. Wagner seconded the motion. All voted Aye. <br />
