Mr. Price said it did not seem safe or practical for tenants to <br /> be living above a manufacturing facility. Mayor Majerus noted the condition <br /> could be modified so that present tenants would not have to move, but when <br /> they left, a new occupancy permit would not be granted. <br /> Mr. 011endorff left the Council chambers at this time, and Deputy City Manager <br /> Susan Glassman took his place. <br /> Mr. Adams moved acceptance of the site plan with all conditions, specifying <br /> that present tenants may remain, but when they leave a new occupancy permit <br /> will not be granted. Mr. Wagner seconded the motion. Mr. Schoomer asked if <br /> it would save the applicant fees if the City Council recommended a referral to <br /> the Board of Adjustment. Ms. Glassman said Council would have to make that <br /> request, and Mr. Srhoomer asked to include that as part of Mr. Adams motion. <br /> Mr. Adams and Mr. Wagner accepted that change. All voted Aye. <br /> SITE PLAN - TORAH PREP SCHOOL <br /> The Deputy City Manager said this site plan was tabled at the last meeting to <br /> enable the applicant to develop more detailed plans to protect adjacent prop- <br /> erties from the adverse impact of a proposed roadway that would run from Wood- <br /> son Road directly to the Torah Prep School. Approval should be given only if <br /> the applicant agrees to fence the playground immediately; maintain the entire <br /> roadway easement area to City standards; submit and accept City staff revi- <br /> sions on detailed plans for the paving, grading, drainage and erosion control; <br /> accept Zoning Administrator rulings on sign limits; install landscaping in ac- <br /> cordance with a landscape plan as may be revised by the City Forester on thor- <br /> ough review; and maintain four evenly spaced security lights along the roadway <br /> She said Council should make it clear that the City is not ruling on the prop- <br /> erty ownership, which is a private civil matter between the parties. Any ap- <br /> proval of the site plan by Council should also not be considered the first <br /> choice of available alternatives; sharing existing roadway/driveway improve- <br /> ments with neighboring nonresidential properties appears to be a better solu- <br /> tion than the site plan currently before Council. <br /> Mr. Schocener moved that this item be taken from the table. Mr. Wagner second- <br /> ed the motion, which carried unanimously. <br /> Mr. Adams wished to add another condition--if the proposed roadway is not <br /> properly maintained to City standards or the building goes to some other use <br /> and the road is not maintained, the property owner must remove the road at his <br /> own expense. There was no objection to adding this condition. <br /> The applicant, Mr. Charles Deutsch, #1 McKnight Place, said he understood and <br /> agreed to all conditions, including immediate fencing of the playground and <br /> the one suggested by Mr. Adams. <br /> Mrs. Schuman asked if the adjacent business, 'ItMCO, 1435 Woodson, was satis- <br /> fied that its concerns had been met. Mr. Bob Killion of 'IbMCO came forward, <br /> and said the meetings with Torah representatives allayed his concerns although <br /> he was apprehensive about what might happen if there was a zoning change, such <br />
