The permit is requested for August 29 <br /> through September 19, 1990 during daylight hours. <br /> ti <br /> Mr. Price moved approval, with Mr. Schooner seconding the motion. All voted <br /> Aye. <br /> i <br /> coma TIC*ThI USE PEST - LIVING WORD APOSTOLIC CHURCH. 7740 OLIVE i. <br /> i <br /> The City Manager concurred in the recommendation of the staff and Plan Commis- <br /> to deny a coalitional use permit for the church that has illegally occu- <br /> pied 7740 Olive for several years. He said Council had approved occupancy on <br /> three different occasions if a series of conditions was met, with the last ap- <br /> proval stating that no further extensions would be considered. The conditions <br /> have not been met, and the applicant is many months behind the unextendable <br /> limit, and has been charged .in municipal court with violating City codes re- <br /> garding occupancy and ply maintenance. <br /> i <br /> Mr. Schooner moved denial, with Mr. Wagner seconding the motion. <br /> Rev. Robert Buckner, 1132 Olive Village, pastor of the church, came forward. <br /> Mr. Price asked for Rev. Buckner's response to the City Manager's statements. <br /> Rev. Buckner said the church just bought the property in January and has been <br /> working since then to comply with the conditions set earlier; however, it has <br /> not been able to get all the work done, partly because of difficulties encoun- <br /> tered in the purchase. He asserted that all exterior work will be completed <br /> by the end of September. He apologized for not having better conanunications <br /> with the City, and said the church's only aim now is to finish the work. <br /> Mr. Adams noted that when this was last before Council he said he would not <br /> vote for another extension, and that he did not want to see this before Coun- <br /> cil again until all work is completed. He said there has been ample time for <br /> the church to communicate with the City about problems being encountered. <br /> Mr. Sthcaner asked if there was evidence of the building being used illegally <br /> since the matter went to court. Mr. 011endorff did not know, but said he has <br /> received no complaints. <br /> F <br /> Mr. Price asked the outcome if the permit is denied but the church continues <br /> to work on the building. Mr. 011endorff said it was reported that the church <br /> was illegally occupying the building after the last deadline (April, 1989) ; a <br /> complaint was filed and the church must now appear in court. In response to <br /> Mr. Price, Mr. 011endorff said the church could continue to work on the prop- <br /> erty to bring it into compliance, but must not occupy the building. The con- <br /> ditional use permit may be reapplied for at any time, he said, but it would be <br /> more reasonable to do so after the required work is done. The church must al- <br /> IL so convince the City and community that they have the willingness to maintain <br /> the property. Rev.
