Session 1529, Minutes <br /> Page 4 <br /> October 1, 1990 <br /> ditional use <br /> permit for a carry-out fish restaurant at 7876 Olive (hours from <br /> 11 a.m. to 10 p.m.) in the Westover Center, with the following conditions: <br /> 1. Signs shall be in strict compliance with the sign code provisions of the <br /> Zoning Code. <br /> 2. Should the City determine that additional centralized trash facilities are <br /> needed, they shall be provided near the restaurant to accommodate this <br /> need. <br /> 3. The operator shall regularly police the site and the area adjacent to the <br /> restaurant to remove litter generated by the business. <br /> Mr. Wagner moved approval with all conditions. Mr. Price seconded the motion. <br /> Mr. Adams said this was the fourth restaurant in this center, and he recalled <br /> his earlier statement that he would vote against additional eating places here. <br /> Mrs. Schuman moved to add another condition, that of controlling fish odors <br /> that might emanate from the restaurant. As the mover and seconder, Mr. Wagner <br /> and Mr. Price agreed to this amendment, as did the rest of the Council. <br /> There was brief discussion regarding center occupancy, believed to be 70% at <br /> this time, and the possibility of restaurant failure due to saturation. <br /> Mr. Price called the question. All voted Aye except Mr. Adams, who voted Nay. <br /> CONDITIONAL USE PERMIT - 7489 DELMAWAUTOMOBIIE SERVICE <br /> The Deputy City Manager said the Plan C czimission recommends approval of allow- k <br /> ing the existing automobile service station (Sinclair) at 7489 Delmar, to add <br /> limited motor vehicle repair, with the following conditions: <br /> 1. Required parking shall conform to the standards for width and length and <br /> shall be delineated to identify separate parking stalls. <br /> 2. The refuse box shall be relocated to the rear of the property away from <br /> public view. <br /> 3. Exist' <br /> frig fencing on the north side of the property shall be extended to <br /> within twelve (12) feet of the Hanley walkway. All existing fencing shall <br /> be maintained in good repair. <br /> 4. A detailed landscape plan shall be submitted to the Director of Planning <br /> for his review and approval. Landscaping shall be installed and main- <br /> tained in accordance with the approved plan. <br /> 5. Overnight outdoor parking or storage of wrecked, derelict, abandoned, <br /> or unlicensed vehicles is prohibited. Overnight storage of motor vehicles <br /> is limited to the parking area to the rear of the building. <br /> Mr. Adams moved approval including all conditions. Mr. Price seconded the mo- <br /> tion. It was determined that the applicant has agreed to comply with all con- <br /> ditions. <br /> ir Mrs. Schuman said her only concern was that overnight parking at the rear of <br /> lime the property should not encroach on the Hanley sidewalk. Director of Planning <br /> Al Goldman suggested adding "directly" to the second sentence in Condition #5, <br />
