An area bounded by the western edge of the required fifteen (15) foot <br /> transitional yard extending north to Vernon Avenue and also bounded by <br /> the Midland Boulevard and Vernon Avenue rights-of-way shall be devoted to <br /> a landscaped area. <br /> 7. Hours of operation shall be limited to 8:00 a.m. - 6:00 p.m. Monday <br /> through Friday, and 8:00 a.m. - 12:00 noon on Saturday. <br /> Mrs. Thompson moved approval, with Mr. Wagner seconding the motion. <br /> Mr. Adams asked about the Saturday noon closing. The operator, Robert Bam- <br /> berger, said Saturday hours will allow customers to retrieve vehicles left <br /> for repair during the week, but no repair work will be done then. <br /> Mr. Price asked about vehicles parked overnight, and the City Manager said <br /> the cars left outside overnight must look like they are in good repair. <br /> All voted Aye. <br /> JACKSON/AHERN RIGHT-OF-WAY VACATION <br /> The City Manager said this item does not require action, but is a report to <br /> Council on the vacation of a small portion of Ahern west of Jackson, request- <br /> ed by Jeff and Joyce May, who wish to build a home at that site. He said a <br /> public hearing was held October 15, and there were few comments on the vaca- <br /> tion, but many on the proposed home. Of the five undeveloped lots adjacent <br /> to the right-of-way, three are unbuildable due to flood plain restrictions, <br /> but portions of the other two appear to be buildable according to an indepen- <br /> dent engineering report submitted by the Mays. To properly serve the pro- <br /> posed single-family residence, it was recommended that the owner extend the <br /> concrete pavement (meeting City specifications) approximately 70 feet. It <br /> was further recommended that the balance of the right-of-way to the west be <br /> vacated and this, plus the existence of the flood plain, will ensure that no <br /> additional development will take place. The street extension will ensure <br /> that the home to be built can be served by police, fire, sanitation, etc. as <br /> well as providing limited parking. He said Council may wish to request prep- <br /> aration of a bill to enact the vacation. <br /> Mr. Adams asked if replatting the site into one lot was being recommended, <br /> and Mr. 011endorff said it depended on the area on which the owners plan to <br /> build--if one of the two lots has an adequate side yard, the lots would not <br /> have to be combined. Mr. Adams said nearby residents were interested in pur- <br /> chasing the adjoining property the Mays had to buy when they bought the lots <br /> they want to build on, and the neighbors wished to know if those lots would <br /> require replatting. Mr. 011endorff said replatting would be required only if <br /> the lots were to be developed, which the flood plain made impossible. <br /> Mr. Miles Cramer, 1065 Jackson, asked haw residents could ensure the certain- <br /> ty that no further development of the flood plain behind the row of houses <br /> will take place, and what the new home will look like. Mr. 011endorff said <br /> new construction must fit in with the existing homes in the neighborhood; any <br /> variance must come before the Council for approval. He said no further con- <br /> struction can take place because the rest of the site is in the flood plain; <br />
