Ms. Colquitt seconded the motion. <br /> <br />Responding to Mr. Lieberman, Mr. Ollendorff stated that disputes would go to the <br />Board of Appeals. <br /> <br />The motion failed five to two. Mr. Sharpe seconded the motion. The roll call vote was as <br />follows: AYES: Mr. Munkel, Mr. Wagner, Mr. Lieberman, Mr. Sharpe, Mayor Adams. <br />NAYS: Ms. Colquitt, Mr. Schoomer. Bill Number 8463 passed and became Ordinance <br />6242. <br /> <br />Mr. Ollendorff said that all of these questions and concerns brought up by the two citizens <br />speaking on this measure will be given to the code official and he is sure that all them will <br />be considered. <br /> <br />BILL NO. 8464 - VACATING AND SURRENDERING A PUBLIC RIGHT-OF-WAY <br />BETWEEN BIRCHMONT DRIVE AND WAYNE AVENUE, EAST OF 79TM <br />STREET, IN BLOCK 9 OF BELMONT HILLS NUMBERS 2 AND 3 <br />SUBDIVISIONS, AND DIRECTING THAT THIS ORDINANCE BE RECORDED <br />IN THE OFFICE OF THE RECORDER OF DEEDS OF ST. LOUIS COUNTY, <br />MISSOURI. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Responding to Mr. Sharpe, Mr. Ollendorff stated that if the owners want them to fence off <br />both ends of this walkway, we will do it. Mr. Sharpe said to go ahead and do it. <br /> <br />Mr. Schoomer stated that he was still concerned about the one resident that has not <br />responded. Mr. Schoomer said that property should then be conveyed only to the resident <br />that is willing to be responsible for it. Mr. Ollendorff said that this is not an option. The <br />only option the Council can take is to vacate it. State law says it goes back to the adjacent <br />properties automatically. <br /> <br />Mr. Lieberman is concerned about what happens in between if you fence both ends. He <br />supposes that the neighbors will move the fences to encompass the walkway areas. <br /> <br />13 <br /> <br /> <br />
