Session 1786 <br />June 5, 2000 <br /> <br />AGENDA ITEM #5 - STREET VACATION PUBLIC HEARING DATE: <br /> <br />Mr. OIlendorff recommends setting June 19, 2000, at 7:30 p.m. in these Council <br />Chambers as the time and place for a public hearing on the proposed vacation of Essen <br />Ave. which is a partially improved street right-of-way going south for 150 feet from Forsyth <br />and primarily used as a driveway to the two adjacent properties. There is no public need <br />for this right-of-way and it would be beneficial to the neighbors to be able to prohibit public <br />access. The adjacent property owners have paid the cost of resurfacing the driveway and <br />the City has paid for narrowing the approach at Forsyth. <br /> <br />Mr. Wagner moved approval. Ms. Colquitt seconded the motion. <br /> <br />Responding to Mayor Adams, Mr. Ollendorff said that each neighbor would own 1/2 of it - <br />there would be no easement. <br /> <br />The motion carried unanimously. <br /> <br />Mr. Schoomer asked the City Manager if he would query the City Attorney on whether it <br />was necessary for the City Council to vote to hold a public hearing or could the City <br />Manager just set them. <br /> <br />AGENDA #6 - CONDITIONAL USE: TELECOM ANTENNA AT 7547 OLIVE: <br /> <br />The Plan Commission finds that this proposal for a 120 ft. high telecommunication antenna <br />designed to resemble a flag pole be approved with a number of conditions: certified <br />structural strength, no signal interference, compliance with FCC and other state and federal <br />regulations, security to prevent public access, prohibiting advertising, no unrelated <br />occupancy or use, matching colors for all accessories, maintenance in like new condition, <br />removal following one year inactive, strict compliance with zoning code, appropriate flag <br />maintenance including lighting limits, and decorative wall subject to Zoning Administrator <br />plan approval. <br /> <br />Mr. Schoomer moved approval. Mr. Munkel seconded the motion. <br /> <br />Mr. Ollendorff referred several questions from Mr. Lieberman to Assistant City Manager <br />Gregory Rose. <br /> <br />Mr. Rose said that the City is pursuing all telecommunication companies that provide <br />service to University City residents or businesses to pay the municipal utility tax. <br />Additionally, this building is under current ownership.
