Session 1789
July 24, 2000

Mr. Munkel stated that the walkway was continuous from Olive to Bartruer, but there is a
barricaded street that goes from Bartruer south and stops at the barricade. It looks like that
there might have been a street all the way through. Will we be vacating the sidewalk or
the sidewalk and street. The petition states that the neighbors are asking for a barrier and
he wonders why we just can't put the barrier up and not vacate.

Mr. Ollendorff stated that the policy is either that we have public property that is open to
the public, which the City maintains or we don't. We don't close public property, we
vacate it. Mr. Ollendorff said that the City would be willing to clean up this property and
put up a fence before vacating it.

Responding to Ms. Colquitt, Mr. Ollendorff stated that there was no meeting. There seems
to be another walkway closer to the corner of the home on Olive that tends to be causing
them problems. He has asked the police to keep an eye on the people walking on this
walkway.

Mr. Sharpe requested that legislation be prepared which would vacate this property.

Mr. Munkel is not opposed with the legislation, but he would like a clarification of who
owns the property here.

Mr. Sharpe said that he would take it upon himself to determine who the owners are and
get something in writing from them.

Mr. Schoomer stated that there is approximately four weeks until the legislation could be
enacted, so the Third Ward Councilmembers should canvass the neighborhood and see
what the most desirable solution to this problem would be.

Mr. Wagner said that he is hearing from the neighbors that they want this walkway shut
down and they want no traffic through there. It sounds like that the City Manager can do
this, but it should be clear to the neighbors that once it is cleaned up and a barricade is
built, the City will no longer be responsible for maintaining it.

Responding to Mr. Munkel's questions about lighting, Mr. Ollendorff stated that one light
has been replaced on this property. The only interest being vacated is the City's. All utility
easements remain in place.

4
