Session 1790
August 7, 2000

subsequently, recommending additional changes that Mr. Mubeen had no objections. Mr.
Mubeen has agreed to a condition that will reduce the hours open by one hour in the winter
months of November through Mamh. The hours would be from 6 a.m. to 10 p.m., Sunday
through Thursday and from 6 a.m. to 11 p.m., Friday and Saturday in those months. They
want to make sure that this conditional use will prevent any liquor licenses at this location
now and in the future. They definitely want the no loitering condition in the conditional
use. They definitely do not want speakers allowed at this location. The neighbors would
also like some input in the landscaping plan when one becomes available.

Elizabeth Proost, 7481 Washington Ave., feels strongly that this is an excellent project and
she and her husband really look forward to having a convenience store in the neighborhood
and believes Mr. Mubeen will be an excellent neighbor.

Mr. Munkel pointed out that Mr. Mubeen was the owner of the Shell Station, which was a
24 hour store. Mr. Mubeen has made many concessions for these neighbors and does not
feel that further restrictions are necessary at this time.

Mr. Lieberman feels that this is an important development and he really would like to
congratulate Mr. Mubeen for meeting with the neighbors and going out of his way in trying
to solve the problems that the neighbors foresaw. He wished all developers would do the
same thing.

Mr. Schoomer asked the two first ward Councilmembers if they would like to propose any
additional amendments to the conditional use permit.

Mr. Wagner moved to add that no petroleum deliveries would be acceptable before 8 a.m.
Mr. Schoomer seconded the motion. The motion to amend carried unanimously.

Mr. Wagner asked that the City Manager make the landscaping plan available to the
residents. Mr. Ollendorff has already agreed to do this.

Mayor Adams asked the Council for any other changes to the conditional use permit. None
was offered. Mayor Adams called for the original question.

The motion to approve carried unanimously.

AGENDA ITEM #3 - CONDITIONAL USE AT 6901 OLIVE:

Residents of the neighborhood next to the proposed Sonic drive-in and drive-thru restaurant
have made it very clear that they prefer that this permit be denied for a number of reasons,

6
