The Plan Commission voted 3-2 for denial <br />of the permit due in part to air quality concerns. <br /> <br />With full respect and understanding of these points of view, Mr. Ollendorff recommends <br />that the permit be approved if the applicant accepts a list of very strong conditions aimed <br />at providing protection for the adjacent residential neighborhood. Mr. Ollendorff <br />recommends approval because the proposal meets the comprehensive plan adopted by the <br />City for redevelopment along Olive Street Rd. which is a very high priority for our <br />community. The Sonic restaurant will only be a good neighbor, however if they agree to <br />the following conditions: <br /> <br />The restaurant shall keep the site clean at all times and shall police the <br />adjacent three residential blocks every morning for restaurant litter. <br />Trash, refuse, and exhaust control systems, must be installed and <br />maintained. <br />Building architecture together with signage must meet sign requirements. <br />Construction must include concrete curbs, brick facade, approved <br />landscaping, screening mechanical equipment, grading plan approval, and <br />installation of an eight foot decorative screening wall at the rear property line <br />including across the walkway if vacated. <br />Daily operating hours between 8:00 a.m. and 10:00 p.m. except midnight <br />Friday and Saturday for a six month trial. <br />Outside speakers shall not be audible beyond the property line. <br />Property lines and site coverage shall be maintained as shown on the site <br />plan without enlargement. <br /> <br />Mr. Ollendorff fully respects the neighbors views, but in his opinion, we can add a new <br />employment and business opportunity to Olive Street Rd. while still protecting a very <br />beautiful residential neighborhood. <br /> <br />Mr. Sharpe moved denial of the conditional use permit. Ms. Colquitt seconded the motion. <br /> <br />Mr. Schoomer said that he was uncomfortable with dealing with the conditional use prior to <br />the vacation of the property. It puts the Council in the position of deciding the fate of the <br />property for which the applicant did not control at the time of the application. Mr. <br />Schoomer would like to table this until the question of the vacation is answered. He will <br />hold the motion until everyone is heard from. <br /> <br />Richard Dockett, 6844 Crest, President of the Roth Grove Neighborhood Association, is <br />against the Sonic Drive In and wonders what will happen to the Speedi-Way printing shop <br />that has been at that location for many years.
