Session 1792 <br />September 11, 2000 <br /> <br />Mr. Munkel moved approval of the conditional use permit as written. Mr. Wagner <br />seconded the motion. <br /> <br />Responding to Mr. Lieberman, Mr. Ollendorff stated that the building owner of the current <br />building would have paid leases at the parking garage. The restaurant did not pay. <br /> <br />The motion to approve carried unanimously. <br /> <br />AGENDA ITEM #5 - CONDITIONAL USE - 7380 OLIVE: <br /> <br />Mr. Ollendorff concurs with the Plan Commission determination that this business complies <br />with all provisions of the zoning code and may be approved subject to a number of <br />conditions. The staff, Plan Commission, and Mr. Ollendorff join in recommending the <br />following conditions: regular litter policing on this and adjacent public properties, refuse <br />and trash containers including around the perimeter of and at the exits, refuse collection <br />only from 8:00 a.m. to 8:00 p.m., odor control exhaust system installation and <br />maintenance, signs conforming to ordinance limits, light strips or strings prohibited, <br />installation of approved landscaping prior to opening, screening roof mechanical equipment, <br />utility service and meters located in accordance with planning director approval, no speaker <br />volumes perceptible beyond property lines, grading/sidewalk/driveways subject to approval <br />by appropriate authorities, lighting shielded from adjoining properties, construction of an 8- <br />foot wall at the rear property line subject to zoning administrator approval, site coverage <br />75.3%. All reviewers also agree that dining and lobby hours shall be limited to 6:00 a.m. <br />to 11:00 p.m. Sunday-Thursday and to midnight Friday and Saturday. Mr. Ollendorff <br />recommends that the drive-thru operation be permitted to remain open until midnight each <br />day. The Plan Commission would allow 24 operation if a police substation was placed on <br />the property. The City cannot afford to assign a police officer to this location and thus we <br />have no interest in requiring a substation. Provision of security must be made the <br />responsibility of the restaurant. Since the applicant claims that the late night drive-thru <br />hours would have no negative neighborhood impact, Mr. Ollendorff suggests that the <br />midnight closing hour be reviewed following six months actual experience. The conditions <br />are as follows: <br /> <br />The operator of the restaurant shall regularly police the site and the area adjacent to <br />the restaurant to remove litter and debris. <br />Trash containers for patron use shall be available on the premises at all times. <br />Adequate refuse disposal shall be provided by and for the business. The refuse <br />containers and surroundings shall be maintained in a clean condition. <br />An exhaust system shall be installed and/or other means shall be taken to prevent <br />any food preparations odors or cooking odors from being perceptible beyond the lot <br /> <br />4 <br /> <br /> <br />
