(b) Whenever request for time on the Public Access <br />Channel exceed the availability of the Channel on a <br />requested date, the following rules shall apply: <br /> <br />(i) First time users shall have priority over <br /> regular users, <br /> <br />(if) A previous user who has not been scheduled <br /> in prime time (6-11 pm) shall have priority <br /> for prime time scheduling. <br /> <br />(ill)All disputes arising over the allocation of <br /> pnblic access tfme shall be resolved by the <br /> Program Coordinator, a person appointed by <br /> the Company responsible for the maintenance, <br /> operation and supervision of its access <br /> channels, equipment and facilities. <br /> <br />(c) Advertising material designed to promote the <br />sale of commercial products or services (including <br />advertising by or on behalf of candidates for public <br />office) fs prohibited in connection with any access <br />cablecasting over the public access channel. <br /> <br />(d) No program, production or presentation shall be <br />cablecast or permitted to be cablecast on the public <br />access channel which involves directly or indirectly <br />any lottery information or which involves a lottery. <br /> <br /> Provided, however, this Section shall not apply <br />to advertisements or lists of prizes or information <br />concerning a lottery conducted by a state acting <br />under the authority of state law when such infor- <br />mation is transmitted: <br /> <br />(i) by the Company's cable system located in <br /> Missouri, <br /> <br />(if) by the Company's cable system located in an <br /> adjacent state which also conducts such a <br /> lottery, or <br /> <br />(ill)by the Company's cable system(s) located in <br /> another state which is integrated with a <br /> cable system described in (l) or (if) <br /> herein, if termination or the receipt of <br /> such transmission by the cable system in <br /> such other state would be technically <br /> infeasible. <br /> <br />(For the purpose of this subparagraph, lottery means <br />the pooling of proceeds derived from the sale of <br />tickets or chances and allotting those proceeds or <br />parts thereof by chance to one or more chance takers <br />or ticket purchasers. It does not include the plac- <br />ing or accepting of bets or wagers on sporting <br />events or contest.) <br /> <br />(e) No program and/or presentation shall be cable- <br />cast or permitted to be cablecast on the public <br />access channel which involves any obscene or <br />indecent material. <br /> <br />(f) The following announcement will appear peri- <br />odically on the public or educational access <br />channel, either before or after the Applicant's <br />program material or during the natural breaks within <br />such program material: <br /> 37 <br /> <br /> <br />
