(vi) A statement that the access channel user is familiar with the definitions and eperating rules of the leased access channel. In addi- tion, a statement that the access channel user has read and understands the sponsorship identi- fication requirements contained in Section 3 (d), (g), and (h) herein and w~11 comply therewith~ (vii)A statement that no lottery is involved and that no lottery information is to be cable~ast, except as permitted by Section 3 (c). if lottery advertisements, iist~ of prizes or information is to be cablecast, a complete description of bow such a cablecast is consistent with Section 3 (c) must be made; (viii)A statement that all appropriate arrangements and clearances have been obtained from broad- cast stations, networks, sponsors, music licensing organizations, performers, represen- tatives and, wlthout limitation by the above, any and all other person (n~tural or otherwise) as may be necessary for authorizations to transmit its program material over the faci- llties of the Company; (ix) The identity of any sponsor pursuant to Section 3 (d) which has directly or indirectly paid or promised to pay the access channel user money or has directly or indirectly proposed to furnish services or other valuable consideration in connection with the access cablecast; and, (x) Such other addition information as is necessary to enable the Company to perform properly its responsibilities. (b) All requests for access are to be submitted at least seven (7) days in advance of the desired date and time of the proposed access cablecast. The Program Coordi- nator may waive the seven day requirement at his/her discretion. (c) All requests shall be processed on a first-come non- discriminatory basis. In cases in which requests are received for the same date and time, in the event of no other available channel capacity, the Program Coordi- nator shall inform the applicants of the dates and time available for their respective access cablecasts. An access channel user may specify alternative dates and times in the initial request. (d) All video tapes of programs or scripts of programs to be cablecast live shall be submitted upon request to the Program Coordinator at least seven (7) days before scheduled to be cablecast so that there will be an opportu~ity for review for illegal content and technical quality. The judgment of the Program Coordinator shall be final with respect to the particular scheduled pro- gram. The Program Coordinator may waive the seven day requirement at his/her discretion. (e) Should the Program Coordinator determine or believe that the statements in the access channel user's appli- cation are false, misleading or incomplete concerning sponsorship identification, arrangements and clearances for authorization to cablecast program material, the presentation of lottery information, or obscene or 44
