(vi) A statement that the access channel user is <br /> familiar with the definitions and eperating <br /> rules of the leased access channel. In addi- <br /> tion, a statement that the access channel user <br /> has read and understands the sponsorship identi- <br /> fication requirements contained in Section 3 (d), <br /> (g), and (h) herein and w~11 comply therewith~ <br /> <br />(vii)A statement that no lottery is involved and that <br /> no lottery information is to be cable~ast, <br /> except as permitted by Section 3 (c). if <br /> lottery advertisements, iist~ of prizes or <br /> information is to be cablecast, a complete <br /> description of bow such a cablecast is <br /> consistent with Section 3 (c) must be made; <br /> <br />(viii)A statement that all appropriate arrangements <br /> and clearances have been obtained from broad- <br /> cast stations, networks, sponsors, music <br /> licensing organizations, performers, represen- <br /> tatives and, wlthout limitation by the above, <br /> any and all other person (n~tural or otherwise) <br /> as may be necessary for authorizations to <br /> transmit its program material over the faci- <br /> llties of the Company; <br /> <br />(ix) <br /> <br />The identity of any sponsor pursuant to Section <br />3 (d) which has directly or indirectly paid or <br />promised to pay the access channel user money or <br />has directly or indirectly proposed to furnish <br />services or other valuable consideration in <br />connection with the access cablecast; and, <br /> <br />(x) Such other addition information as is necessary <br /> to enable the Company to perform properly its <br /> responsibilities. <br /> <br />(b) All requests for access are to be submitted at least <br />seven (7) days in advance of the desired date and time <br />of the proposed access cablecast. The Program Coordi- <br />nator may waive the seven day requirement at his/her <br />discretion. <br /> <br />(c) All requests shall be processed on a first-come non- <br />discriminatory basis. In cases in which requests are <br />received for the same date and time, in the event of no <br />other available channel capacity, the Program Coordi- <br />nator shall inform the applicants of the dates and time <br />available for their respective access cablecasts. An <br />access channel user may specify alternative dates and <br />times in the initial request. <br /> <br />(d) All video tapes of programs or scripts of programs <br />to be cablecast live shall be submitted upon request to <br />the Program Coordinator at least seven (7) days before <br />scheduled to be cablecast so that there will be an <br />opportu~ity for review for illegal content and technical <br />quality. The judgment of the Program Coordinator shall <br />be final with respect to the particular scheduled pro- <br />gram. The Program Coordinator may waive the seven day <br />requirement at his/her discretion. <br /> <br />(e) Should the Program Coordinator determine or believe <br />that the statements in the access channel user's appli- <br />cation are false, misleading or incomplete concerning <br />sponsorship identification, arrangements and clearances <br />for authorization to cablecast program material, the <br />presentation of lottery information, or obscene or <br /> <br />44 <br /> <br /> <br />
