i <br /> i <br /> j <br /> i <br /> i <br /> s <br /> i <br /> 3 <br /> X <br /> } <br /> the use, operation, maintenance, repair, or leasing of same <br /> without first obtaining the prior written approval of the <br /> Authority as to the specific funding or assistance to be <br /> utilized by the Redeveloper . <br /> Section 8. Site Plans . The Redeveloper has submitted <br /> to the Authority site plans (the "Site Plans" ) for the improve- <br /> ments to be constructed on the Project Area. The Site Plans <br /> may be modified by the Redeveloper after approval thereof in <br /> writing by the Authority as design and construction progress so <br /> long as the Site Plans as modified are in substantial con- <br /> formity with the provisions of the Plan, the Proposal, this <br /> Agreement and applicable State and local laws and regulations. <br /> Section 9. Timing. Construction on the Project Area <br /> will begin in December of 1984, and it is presently intended <br /> that it will be completed prior to , 198_, subject <br /> to the following extensions : <br /> (a) Financing is not available to the Redeveloper in <br /> such amounts and at such interest rate and upon such other <br /> terms, provisions and conditions as are acceptable to the <br /> Redeveloper; provided, however, that any extension of this <br /> subparagraph shall not extend beyond , 198_; <br /> (b) Failure of the City to grant site plan approval <br /> within thirty ( 30 ) days following submission of an application <br /> for site plan approval; or <br /> (c) Any other cause beyond the reasonable control of <br /> the Redeveloper as set forth in Section 11 . <br /> Section 10. Certification of Completion of <br /> Improvements. Promptly after the Redeveloper has notified the <br /> Authority in writing of the date on which the construction of <br /> the improvements has been substantially completed in accordance <br /> with the Plan, the Site Plans, and this Agreement, the Author- <br /> ity shall certify that construction of the improvements has <br /> been so completed. If the Authority shall refuse or fail to <br /> provide certification in accordance with the provisions of this <br /> Section, the Authority shall within thirty ( 30 ) days after <br /> written request by the Redeveloper, provide the Redeveloper <br /> with a written statement indicating in what respect the Rede- <br /> veloper has failed to complete the construction of the improve- <br /> ments in accordance with the Plan, the Site Plans, and this <br /> Agreement or failed to satisfy any other agreements or <br /> covenants in this Agreement obligating the Redeveloper in <br /> respect of the construction of the improvements, or in what <br /> respect the Redeveloper has been in default in respect of any <br /> of its obligations under this Agreement. The certification <br /> provided for in this Section shall be in such form as will <br /> -4- <br />
