Agreement II (hereinafter described as "Exhibit G") which it has in <br />escrow. <br /> <br /> 6. Construction, Maintenance and RePair of the London <br />Parkind Lot. During the term of the London Parking Lot Easement, <br />London shall be responsible for the maintenence and repair of the <br />London Parking Lot in accordance with all applicable laws, <br />ordinances, rules and regulations, at the expense of London. <br />Maintenance and repair shall include resurfacing, as necessary, and <br />snow and debris removal, as necessary. The City hereby <br />acknowledges and agrees that London shall, at its sole cost and <br />expense and pursuant to validly issued permits, relocate the <br />telephone utility pole from the property immediately to the east of <br />the London Parking Lot onto said London Parking Lot as shown on the <br />Approved Plans. The improvements comprising the London Parking Lot <br />shall be constructed by London at its sole expense in accordance <br />with plans and specifications approved by the City or its <br />appropriate agency (such approval not to be unreasonably withheld <br />or delayed). The plans and specifications prepared byTheLawrence <br />Group, Inc. dated , 1993 for the London Parking Lot are <br />hereby approved by the parties, and such approval shell be <br />evidenced on such plans and specifications by initialling or other <br />appropriate identification thereof bytheparties. As so approved, <br />said plans and specifications are incorporated herein by this <br />reference and are hereinafter referred to as the "Approved Plans". <br />In the event such maintenance and repair is not carried out to the <br />City's satisfaction, the City my, after fifteen (15) business days <br />written notice to London, perform such maintenance and repair and <br />London shall reimburse the City for the costs thereof within thirty <br />(30) days thereafter. <br /> <br /> 7. Maintenance and RePair of the C_.--w-.~u Lot. During the <br />term of the Common Lot License and the London Parking Stall <br />Easement, the City shall be responsible for the maintenance and <br />repair of the Conunon Lot including the London Parking Stalls, at <br />its expense. Maintenance and repair shall include resurfacing and <br />restriping, as necessary, and snow and debris removal, as <br />necessary, for the use of the Common Lot as a parking lot. <br /> <br /> 8. Duration of Easement and Lioanse. The term of each of <br />the London Parking Lot and Parking Stall Easements and the Con=non <br />Lot License shall be for the earlier to occur of (i) twenty (20) <br />years conunencing upon the date upon which an occupancy permit is <br />issued to London by the City permitting occupancy of the London <br />Property and the London Parking Lot or (ii) the recording of the <br />executed Parking Easement and License Agreement II dated <br />~f~ Z~ , 1993 attached hereto as Exhibit G which shall be held <br />in escrow by a title company selected by London.
