The City and the Authority wish to enter into this <br />Agreement to cooperate for the planning and development of <br />certain public improvements to the Tivoli Building and for the <br />provision of certain common services and to define and clarify <br />their respective expectations and responsibilities with regard to <br />those improvements. <br /> <br /> AGREEMENT <br /> <br /> NOW, THEREFORE, in consideration of the above premises and <br />the mutual covenants and agreements set forth below, the Parties <br />hereby agree as follows: <br /> <br /> 1. Public Improvements. The Authority agrees to oversee <br />the rehabilitation of the Tivoli Building and to ensure that all <br />improvements to the Tivoli Building are undertaken in conformance <br />with the Eastgate-Westgate Urban Renewal Plan, MoR-43, as <br />amended, approved by the City Council by Ordinance No. 5786 on <br />January 21, 1991, and will eliminate the blighted condition of <br />the Tivoli Building and preserve the character of the surrounding <br />neighborhood. <br /> <br /> 2. Scope of Improvements. The Authority agrees that it <br />will ensure that any rehabilitation of the Tivoli Building will <br />include rehabilitation of the facade, storefronts and the theatre <br />portions of the Building.
