licensed to sell such intoxicating liquor at retail, the sum of one hundred fifh/ <br />dollars ($150.00); <br /> <br />(f) <br /> <br />For the privilege of selling intoxicating liquor of all kinds by a wholesaler to a <br />person duly licensed to sell such intoxicating liquor at retail, the sum of five <br />hundred dollars ($500.00); however, a license authorizing the holder to sell to <br />a duly licensed wholesaler shall not entitle the holder thereof to sell within the <br />city direct to retailers; further, a wholesaler's license shall not authorize or entitle <br />the holder thereof to sell to other wholesalers or to solicit orders for the sale of <br />intoxicating liquors, to, by or through a duly licensed wholesaler, within this city. <br />However, solicitors, manufacturers and blenders of intoxicating liquor shall not <br />be required to take out a merchant's license for the sale of their products at <br />the place of manufacture or in quantities of not less than one (1) gallon. <br /> <br />(3) Retailers: <br /> <br />(a) <br /> <br />The applicant for any license under paragraphs (a), (b), (c)nd (e) of this <br />subsection, except when applying for a renewal of any license, shall pay a <br />filing fee of ten dollars ($10.00) therefor to the director of finance. No license <br />shall be issued for the sale of all kinds of intoxicating liquor in the original <br />package, not to be consumed upon the premises where sold, except to a <br />person engaged in, and to be used in connection with, the operation of a <br />grocery store, a drugstore or a cigar and tobacco store; however, the total <br />number of cigar and tobacco store licenses in force shall not exceed two (2). <br />The gross receipts of retail sales of groceries or drugs, or other associated <br />products, shall exceed the gross receipts of liquor sales each year preceding <br />license renewals; except that any existing retail outlet for intoxicating liquor in <br />the original package, which has been in existence prior to the enactment of <br />this division and also in the event of a sale of such business, shall be eligible for <br />renewal of its license at its present site, if it keeps a stock of goods having a <br />value according to invoices of at least one thousand dollars ($1,000.00), <br />exclusive of fixtures and intoxicating liquors. Under such license, no intoxicating <br />liquor shall be consumed on the premises where sold nor shall any original <br />package be opened on the premises of the vendor except as otherwise <br />provided in this law. For every license for sale at retail in the original package, <br />the licensee shall pay to the city one hundred fifty dollars ($150.00) per year. <br /> <br />(b) <br /> <br />For a permit authorizing the sale of malt liquor containing alcohol in excess of <br />three and two-tenths percent (3.2%) by weight and not in excess of five <br />percent (5%) by weight by grocers and other merchants and dealers in the <br />original package direct to consumers but not for resale, twenty-two dollars <br />and fifty cents ($22.50) per year. The phrase "original package" shall be <br />construed and held to refer to any package containing three (3) or more <br />standard bottles of beer.
