Session 1794
October 16, 2000

Responding to Mr. Munkel, Ms. Erker reported that there was an utility easement in
between her property and the project property. Responding further to Mr. Munkel, Ms.
Erker stated that the transformer was on a pole, which is on the right side of her property.

Mr. Sharpe moved that a condition be added that prohibits trash collection prior to 7 a.m.
and not after 6 p.m. Mr. Wagner seconded the motion.

Mr. Wagner asked Ms. Erker if the developers had commented on the finish of the building.
Ms. Erker said that she believed at that time it was still undetermined. Mr. Berry said that
the building will be all brick, and that brown and red are typically the colors they choose.
He does not see any reason why the residents can't be notified when a brick and mortar
color mock up is done so they can get their comments on it. Mr. Berry further commented
that they have already had a meeting with AmerenUE about the transformer issue and they
do realize U. City's code requirements for installing a new one. This also can be shared
with the residents.

Mr. Schoomer noted a problem with the previous motion, since it is impossible to move an
amendment since there was not a main motion to amend. He asked Mr. Sharpe to
withdraw his motion from the floor and restate it.

Mr. Sharpe withdrew his standing motion.

Mr. Sharpe moved approval of the project with all conditions including an added condition
that prohibits trash collection prior to 7 a.m. and no later than 6 p.m. Mr. Wagner
seconded the motion.

Mr. Wagner would like to point out that Mr. Lieberman, who could not be here tonight, was
concerned about this issue. Mr. Leiberman wanted to see a fully advertised public hearing
prior to any Council decision. Mr. Wagner asked Mr. Ollendorff again if the City satisfied
Mr. Lieberman's concerns about notifying the residents. Mr. Ollendorff stated yes it did.
He said that Mr. Lieberman was unaware that the notice had went out. Mr. Ollendorff read
the copy of the notice.

The motion carried unanimously.

CITY CLERK'S DOCKET:

SECOND AND THIRD READINGS:

NONE.

6
