Session 1797
November 13, 2000

#1 - Pool Renovation Study: Mr. Ollendorff requests confirmation by City Council of the
contract with EDM, Inc. for preliminary Heman Pool renovation design in an amount not
to exceed $15,000 as directed by the City Council at previous meetings. This firm has
carried out earlier studies and design work for the Heman Pool and is thoroughly
familiar with our needs.

Mr. Schoomer moved approval of the consent calendar. Mr. Wagner seconded the
motion, which carried unanimously.

AGENDA #2 - BEER & WINE LICENSE - 8406 OLIVE:

The Council may approve the requested license to serve beer and wine by the drink at
this restaurant. They have had a license in the past with no adverse consequences,
but since there is a name change in ownership and no fees were paid last year a
license can only be reissued with City Council approval. We have found no reason to
deny this license request.

Mr. Wagner moved approval. Mr. Munkel seconded the motion.

Responding to Mr. Lieberman, Mr. Ollendorff said that the City Attorney has told him
that any by the drink license holder could also sell the same products by the package.
If they are limited to beer and wine by the drink, they would be also limited to beer and
wine by the package. This licensee says, on their application, that they want to sell just
by the drink, but they could sell by the package, if they chose.

The motion to approve carried unanimously.

AGENDA #3 - TELECOMMUNICATION TOWER AT 7220 WATERMAN:

Mr. Ollendorff agrees with the Plan Commission that a proposed telecommunications
antenna disguised as a flagpole may be permitted on the Flynn School grounds if
appropriate conditions are included. Conditions should include that plans must
demonstrate conformance with building code requirements, federal and state
regulations, protection against signal interference, security controls, appropriate
maintenance of the pole and flag, compliance with lighting specifications, provision of
landscaping, building approved screening wall and gate, prohibitions on signage and
non-related occupancy, and removal if inactive for one year. The conditions are as
follows:

The applicants shall provide sufficient information in the building permit
application that shows that the antenna pole (flagpole) has sufficient structural
strength to support itself and the proposed equipment. The pole shall also be
