Session 1799 <br />December 18, 2000 <br /> <br />AGENDA ITEM #5: CONDITIONAL USE PERMIT - 2 MCKNIGHT PLACE - 8654 <br />BARBY: <br /> <br />Mr. OIlendorff agrees with the Plan Commission recommendation that a conditional use <br />permit allowing the construction of this nursing home addition be approved subject to all <br />relevant prior conditions and other conditions related directly to this project, as follows: <br />properly directed lighting, on-site parking without public street utilization other than <br />McKnight Place, approved drainage and grading, installation of odor controlling exhaust <br />systems, detailed landscape plan and installation, 90 patient limit, detailed construction <br />traffic and parking provisions prior to building permit issuance, maintaining bus stop <br />trash receptacle, compliance with height and mass limits on approved plan, <br />construction and conformance with this plan and all zoning code requirements, and a <br />completed traffic study paid for by the applicant demonstrating appropriateness of a <br />Barby entrance. The approval of this conditional use permit should follow the adoption <br />of the rezoning ordinance. <br /> <br />Mayor Adams wants Mr. Ollendorff to make sure that the traffic study includes whether <br />people are violating the stop signs at that intersection. He also wants to see that the <br />construction crews follow a better clean up process. Mr. Ollendorff stated that he would <br />add these both as conditions to the permit. Mayor Adams asked for further clarification <br />on the condition regarding lighting. Mr. Ollendorff read condition #4 in detail: Lighting of <br />all exterior areas, including all parking areas, shall comply with the requirements of <br />Section 34-93.7 of the zoning code and shall be designed to be cornpatible with <br />surrounding areas and shall be shaded to direct light downward and away from abutting <br />uses. <br /> <br />Mr. Wagner said that what Mr. Ollendorff read does not give him a lot of comfort that we <br />are going to address Ms. Reiling's concern. It talks about where the light is directed, <br />but if you look at some of her pictures, it is the reflected light that is the problem. Mr. <br />Ollendorff said that specifically, the condition says, "...shall be shaded to direct light <br />downward and away from abutting uses..". Mr. Wagner says that direct light is not the <br />problem, reflected light is and he believes the code falls short of this particular problem <br />and does not address Ms. Reiling's concern. Mr. Wagner also asked if the traffic study <br />would be reviewed by City staff and feels the term "appropriateness" is a nebulous term <br />and he has no idea what this really means. He asked City Manager for a more explicit <br />definition. Mr. OIlendorff read condition #13: "A traffic study shall be performed by the <br />applicant prior to the issuance of the conditional use permit that shows that the <br />entrance onto Barby will not have a detrimental effect on the surrounding properties on <br />the 8600 block of Barby. Said traffic study shall be approved by the Director of Planning <br />and the Director of Public Works." Mr. Wagner said that there is a prohibition of trucks <br />on Barby Lane, and now there are complaints that trucks are entering way up on the <br />west end of Barby Lane.
