Session <br />January <br /> <br />1800 <br />8,2001 <br /> <br />BILL NO. 8503 - VACATING AND SURRENDERING TWO PORTIONS OF THE <br />RIGHT-OF-WAY OF HARRISON AVENUE BETWEEN HAWTHORNE PLACE <br />AND WAYNE AVENUE IN BELLMONT PLACE SUBDIVISION AND <br />HAWTHORNE TERRACE SUBDIVISION, BUT RESERVING ANY PUBLIC <br />UTILITY EASEMENTS, AND DIRECTING THAT THIS ORDINANCE BE <br />RECORDED IN THE OFFICE OF THE RECORDER OF DEEDS. <br /> <br />The bill was given its second reading. <br />The bill was given its third reading. <br /> <br />Mr. Munkel moved approval. Ms. Colquitt seconded the motion. <br /> <br />Mr. Lieherman stated that this bill was delayed from the last meeting because he had <br />asked if the adjacent owners on both properties were accepting the maintenance of <br />those areas being vacated. Mr. Ollendorff said that Mr. Rose made; repeated efforts; <br />writing, telephone, on-site visits, and only one of the property owners responded that he <br />does in fact wants to acquire this property. Second one responded that the owner was <br />looking at it favorably, but wanted to check with her spouse. They have not responded <br />back. The other two have never responded to any of our communications. He is <br />assuming that they have no objections, because they have had more than enough time <br />to let them know. Mr. Lieherman says that the problem is that if you have two property <br />owners not willing to maintain the property after it is vacated and then it becomes <br />weeds, how can you justify to coming in and doing the work on it that we have been <br />doing all along. Mr. OIlendorff said that we would put a tax lien on their property and a <br />summons to court, if necessary. <br /> <br />Mr. Sharpe would really like to delay this again until the two other property owners are <br />notified, otherwise he will vote no on this. <br /> <br />Mayor Pro Tem Schoomer suggested defeating this bill and then reintroducing it at a <br />time when all the property owners agree. Mr. Sharpe agrees. <br /> <br />Mr. Ollendorff stated that this request came from one of the property owners originally. <br />He suggested vacating only the property from the two owners that have responded and <br />hold off on the other two that haven't responded. <br /> <br />Gregory Rose, Deputy City Manager, stated that the property owners that have <br />indicated a willingness to take over the maintenance - one is adjacent to 7600 Lynn and <br />the other is adjacent to 7602 Wayne. The individual adjacent to 76;02 Wayne is the one <br />that has been maintaining the property for several years now. <br /> <br />6 <br /> <br /> <br />
